The Terms and Conditions for using IMILE's website are as follows:
In accordance with Article 70 of Law No. 10,833, dated 29 December 2003, senders and recipients of international shipments are required to properly store and maintain all documents related to export or import operations. This measure is crucial to ensure compliance with Brazilian tax and customs legislation and to avoid potential sanctions.
Key documents to be retained include:
These documents must be kept for at least five years, as per Brazilian tax regulations, for auditing purposes.
To facilitate compliance, our company includes detailed instructions in documents related to shipments, which are delivered directly to senders and recipients. This ensures all parties are aware of their legal responsibilities.
Failure to provide the necessary documentation may result in:
Customs declarations for express shipments are managed via Siscomex Remessa, with the Federal Revenue Service selecting shipments for inspection based on risk criteria. Courier companies must inform recipients about inspections and the verification process.
Express shipments under the Simplified Taxation Regime have a value limit of USD 3,000 per item. A 60% Import Tax applies to the value plus freight, and an 18% ICMS tax is levied on the total amount.
Individuals can import up to USD 3,000 per shipment, provided the activity is non-commercial and follows IN 1737/2017 regulations. Businesses are limited to USD 3,000 per shipment and up to USD 100,000 annually for commercial purposes.
Imports in quantities or frequencies that suggest commercial activity by individuals are prohibited.
Express shipments adhere to standards set by the RFB, with a maximum width of 70 cm, height of 90 cm, and up to 150 kg. Shipments are checked for compliance through inspections at collection points and non-invasive detection equipment at airports.
Restricted items include:
Exceptions include:
International shipments are subject to selection for customs inspection based on criteria set by the Federal Revenue Service of Brazil (RFB). Courier companies and the ECT must notify recipients about inspections.
Shipments not selected are released automatically, but irregularities may result in retention.
Customs inspection involves document analysis and, if necessary, physical verification by RFB officials. Irregularities can halt clearance, requiring resolution within 30 days. Recipients may contest tax assessments through a review process with a final decision in a single instance.
Unless otherwise agreed, the products and services described on these pages are subject to IMILE's clearance Terms and Conditions. As these terms may vary depending on the shipment’s country of origin, we recommend contacting the nearest IMILE service centre to obtain a copy of the applicable terms and conditions.
